Felony BUI

Convictions for a first and second BUI offense are misdemeanors. However, more serious BUI offenses will bump up a BUI into the felony category.

A boater who receives a Third BUI conviction – If the 3^rd conviction is within 10 years of a prior conviction, it’s a 3^rd degree felony; minimum mandatory 30 days imprisonment. As a condition of probation, 90-day vessel impoundment or immobilization of any one vehicle registered in the defendant’s name for a period of 90 days (though, this impoundment or immobilization can be dismissed if it would cause a hardship to a third party).

If the third conviction is outside of 10 years from a prior conviction, fine of $5,000 and up to 12 months imprisonment. If boater commits a Fourth BUI offense, regardless of timing, that person has committed a third degree felony. Any fine imposed will not be less than $2,000

BUI Manslaughter; Causing or Contributing to Death of Another

• Second Degree – BUI Manslaughter – BUI Causing or Contributing to Death can be charged as a Felony in the Second Degree punishable by up to fifteen (15) years in Florida State Prison and a $10,000 fine.
• First Degree- BUI Manslaughter – BUI Causing or Contributing to Death has the same elements as BUI Manslaughter in the Second Degree except that the operator of the boat also at the time of the accident, knew or should have known that the accident occurred (although it is not necessary that the operator know that the accident resulting in injury or death) and failed to give information or render aid. Charged as a Felony in the First Degree punishable by up to thirty (30) years in jail and a $10,000 fine.
