Forgery

FORGERY UNDER FLORIDA LAW

One of the most common felony charges seen in our criminal courts in South Florida today is forgery or “Uttering a Forged Instrument.” The crime of “uttering” usually occurs when someone passes a check for goods or money… except that the check used doesn’t belong to that person.

Forgery and uttering a forged bill, check, draft or note is typically a 3rd degree felony, punishable by up to 5 years in prison.

Florida’s Forgery Statutes under Chapter 831 covers a wide range of related crimes:

  • Forgery,
  • Uttering forged instruments,
  • Counterfeiting,
  • Forging or counterfeiting private labels,
  • Possession of reproduction materials,
  • Changing or forging certain instruments of writing,
  • Fictitious signature of officer of corporation,
  • Forging bank bills, checks, drafts, or promissory notes,
  • Possessing certain forged notes, bills, checks, or drafts,
  • Uttering forged bills, checks, drafts, or notes,
  • Bringing into the state forged bank bills, checks, drafts, or notes,
  • Making or possessing instruments for forging bills,
  • Forging or counterfeiting doctor’s certificate of examination.

Arrested? Charged with Forgery? Worried about the consequences?

Very often the person passing the “bad check” is not the person who made the check, instead they are promised a small portion of the merchandise or money that is received. The real counterfeiters won’t try to pass the bad check themselves…they prey on folks who desperately need the money and give them a very small cut of their ill-gotten profits. If you’ve been arrested for forgery or a forging-related offense, you will need immediate representation by a skilled Florida Criminal Defense Attorney if you are to have any chance of saving your freedom and avoiding a conviction.
