If you’ve been arrested for Grand Theft, then here’s something you must know…

Under the laws of Florida Grand theft is never a misdemeanor offense; it is always a felony offense. Since Grand Theft is a felony, if you were charged with grand theft youshould be taking this charge very seriously.

Based on the value of the property or the type of property taken grand theft can be either a

  • 3rd degree felony: involves the theft of
    • any property worth $300 – $19,999, or a theft of a
    • firearm,
    • fire extinguisher,
    • commercially farmed animal,
    • a person’s Last Will, Codicil or other Testamentary document,
    • anhydrous ammonia (used in illegal drug manufacturing),
    • a stop sign,
    • anything taken from a designated construction site,
    • any property valued at $100 to $300 when taken from a home, apartment or other dwelling.

Grand theft of the 3rd degree is punishable by up to 5 years in state prison and/or a fine of up to $5,000.

  • 2nd degree felony, is the theft of
    • any property worth $20,000 – $99,999, or theft of
    • emergency medical equipment taken from a hospital or from an ambulance, or
    • law enforcement equipment

Grand theft of the 2nd degree is punishable by up to 15 years in prison and/or a fine of up to $10,000.

  • 1stdegree felony, is the theft of
    • any property worth $100,000 or more, ora
    • theft involving property damage valued at $1,000 or more, or a
    • theft involving the use of a car, truck or other motor vehicle (other than using it as a getaway vehicle) in the commission of a crime which results in damage to real property.

Grand theft of the 1st degree is punishable by up to 30 years in prison and/or a fine of up to $10,000.

Theft During an Emergency

Thefts during an emergency are automatically enhanced by one level; in other words if you committed a theft ordinarily classified as a 3rd degree felony, you will be charged with a 2nd degree felony.
